TERMS AND CONDITIONS:
A. AGREEMENT
This Agreement is between you and HIPAOS, LLC, ("HIPAOS," "we" or "us"), including our contractors, subcontractors or assigns. HIPAOS, LLC is a Florida Limited Liability Company whose principal place of business is 2632 Carvell Court, Winter Park, FL 32792. HIPAOS may elect to subcontract, sublet or assign such portions of services under this Agreement as it, in its sole discretion, deems necessary.
This agreement contains terms, conditions and disclosures for your use of HIPAOS' online services. Your use of this website shall indicate that you have read and agree to abide by these terms and conditions. We reserve the right to change portions of this agreement at any time and without additional notice. It is your responsibility to read and agree to the terms and conditions whenever you use this website. If you do not accept the terms and conditions as set forth herein, or if you do not meet or comply with the provisions, you may not use this website.
A.1. Term of Agreement There is no term limit. Your membership is open ended and will last as long as you comply with the terms, conditions and disclosures of this document.
A.2. Free membership
Membership on this web site is ABSOLUTELY FREE. If you choose to become a member, you will continue to enjoy unlimited access to your medical information account. You will be able to update your information and print new wallet files at any time, day or night (however, certain computer maintenance or malfunctions may make it unavailable from time to time. HIPAOS will not be responsible for any outages in its online service, regardless of the cause for such outages).
A.3. Suspension of Privileges
We may at any time, and in our sole discretion, limit or cancel the services we offer you. Specifically we reserve the right to block access if we suspect fraudulent activity.
We do ask, as a minimum, that you visit and update your stored account at least every two years. We reserve the right to remove accounts in which there has been no activity for the past twenty-four months. Before doing so, however, we will attempt to contact you. Of course, you can cancel you account at any time. To cancel, first access your account by entering your user name and password. Next, click on "Account Settings," and then choose "Delete Account." Please be sure this is what you want to do; once you click "Delete Account," we will have no way to recover your personal data.
B. PRIVACY POLICY
This privacy policy governs all information collected through any website owned and operated by HIPAOS, LLC.
B.1. HIPAOS' commitment to your privacy
We are obligated to make every reasonable effort to protect your medical information and your personal privacy from inadvertent disclosure. As described throughout this document, we take that obligation seriously, and have taken steps to meet or exceed the best practice standards for Internet security. For that reason, no account or personal information can be accessed or retrieved when a visitor browses the public (pre-login) areas of any HIPAOS web site.
It is our policy, except under the very narrow legal circumstances described in this paragraph, that no personal medical information contained in your account will be divulged to any other person. We will not sell, market or disclose your personal medical information to third parties or reveal other details about your health records without your permission. However, we reserve the right to disclose or report such personal information -- in limited circumstances -- where we believe in good faith that disclosure is required to cooperate with regulators or law enforcement authorities. We may need to share your private health information with our own affiliates and contractors, but only to the extent reasonably necessary to operate this website and provide related services. We do reserve the right to adjust this privacy statement in our sole and absolute discretion, without additional notice.
By confirming your agreement, you also pledge to hold harmless HIPAOS, LLC and/or its contractors under federal and state privacy laws for any inadvertent or deliberate online disclosure of personal information. You also acknowledge (through the content of this Legal Disclaimer and Privacy Statement, and by your continued use of any HIPAOS website) we have fulfilled our obligation to disclose how we will use your personal information.
B.2. Online security
We have taken many precautions to protect your information from loss, misuse or alteration. We operate secure networks protected by industry standard firewalls and password protection systems. Only authorized individuals have access to the information provided by our users.
We use Secured Socket Layer ("SSL") transmission encryption to protect transmission of personal information you enter into your online account and emergency response wallet file. SSL lets your browser send and receive information in an encrypted format. The information you store with us is encrypted before it is saved. That way, should any unauthorized user ever penetrate our security, your stored information can not be read.
Your browser's security icon, typically found at the bottom of your browser's window, reflects the security condition of the browser. The padlock icon indicates that your browser is communicating over a secured link.
B.3. Your responsibility
You acknowledge that we are only providing secure, private data storage plus blank wallet file templates for your personal use. Further, you agree you are solely responsible for the accuracy of information you enter into your account and which will be the source for data appearing on the personal medical wallet file you produce from that account.
You agree to hold us harmless for any misspellings, incorrect dosages, or other errors you make when entering your personal health information into our system. You agree HIPAOS, LLC, cannot be held responsible for your errors or negligent use of the service due to:
Errors of commission or omission while entering information;
Failure to maintain confidentiality of or sharing of passwords and/or access information leading to unauthorized access to accounts. This includes storing passwords (through functions such as "autocomplete") on any PC or device that may be collected and retransmitted (as in the case with "spyware.");
Failure to "Sign Off" when completing an online session, leaving a computer unattended during an online session, or storing identification or password information in a computer.
As a member, you have a responsibility to safeguard your personal and medical information. You can do so by following these simple guidelines:
Protect your sign-in information and password.
Use caution when disclosing your account access details to other persons. If someone contacts you, either by telephone or e-mail, says they represent HIPAOS and asks for your account information, do NOT give it to them. No one from HIPAOS, will ever contact you to ask for your personal information either by telephone or e-mail. We recommend you hang up and e-mail us at support@myemergencymedicalfile.com or telephone us directly at 321-274-1741 (between 9 AM and 5 PM, Monday through Friday, Eastern Time) to verify the call is legitimate.
B.4. Our promise to you
The HIPAOS data network is defined as the point from your modem connection on the Internet to the final system on which a given transaction is accessed and stored by one of our servers. We promise that this entire data network will be constantly protected by a system of firewalls and other technology, making it stronger and more secure than some online banking systems. We will use security coding techniques to protect against unauthorized access to personal records, ensure accuracy and integrity of communications and transactions, and protect member confidentiality.
You will need to use certain types of computers, obtain an Internet account, and use browser software before you can access HIPAOS' online services. The installation, maintenance, and operation of those items are your responsibility. We are not responsible for any errors or failures of your computer equipment or Internet connection software. HIPAOS' online services -- and our commitment to protect your privacy -- begin at the interface of your modem connection with the Internet.
C. YOUR CONTACT INFORMATION

When you provide us with your name and contact information, it is recorded in a secure database that is owned and managed by trusted HIPAOS contractors.
C.2. How we utilize your personal contact information
Your contact information will be utilized by HIPAOS or its business associates to contact you by mail or e-mail so we can provide information we think may be of particular interest to you.
We will contact you whenever . . .
You are entitled to free upgrades. We plan to change the format of our wallet files whenever better ideas come along. Whenever that occurs, we will tell you so you can print off a new, improved wallet file.
We learn about new health issues we think are important to you (you will have the opportunity to opt out of these helpful mailings at your request). If there has been no activity in your account for two years. We hope always to keep you as a member, but we will remove inactive accounts unless their owners respond to our e-mail inquiry.
You may also receive promotions or solicitations from us or third party associates. You can opt out of such mailings, either by clicking the unsubscribe link at the bottom of the e-mail itself, or by contacting us at support@myemergencymedicalfile.com. Regardless of whether you choose to unsubscribe to these mailings or not, you may continue to use the website and our services.
C.3. Your Password
Our computers will store your password as part of our security system. Should you ever need password help, simply click on the "Forgot My Password" link, and our computer will automatically send it to you via e-mail. If this does not work, or if you have changed e-mail providers, telephone us at 1-321-274-1741 (between 9 AM and 5 PM, Monday through Friday, Eastern Time).
C.4. How we track visitors to our web sites
An IP address is the unique number that identifies your computer from all others when you log onto the Internet. As you enter HIPAOS' site, our server records and monitors your IP address and uses it to develop aggregated statistical analysis. These analyses assist us in refining and adapting the content and design of our site. By accessing any HIPAOS web site you acknowledge and authorize such recording and monitoring of your computer's IP address.
The use of IP addresses also helps us prevent malicious Internet users from masquerading as authorized users. By interrogating your computer's IP address, HIPAOS seeks to protect your data from unauthorized users. However, HIPAOS hereby disclaims all liability should any unauthorized user access one of our sites with your user name, password and IP address.
C.5. How we use "Cookies"
A cookie is a piece of text or data that can be stored in the memory of your web browser. This data can only be retrieved by the server/domain that places the cookie.
HIPAOS employs cookies for the following purposes:
To enable automatic form validation/entry (if "remember me" is selected in site store).
To enable online polling (cookies allow us to prevent people from answering our surveys more than once).
To compile statistics concerning items offered online.
HIPAOS NEVER stores medical, financial or Credit Card data within cookies. Those who feel uncomfortable with cookie technology can disable cookies within their browser settings (if you are unsure how to do this, seek the advice of your particular browser's technical support professionals). Our web sites are designed to operate with or without cookies. However, some functionality will be removed when cookies are disabled, and HIPAOS shall not be responsible for lost or altered data resulting or related to such disabling of cookies.
C.6. The option to cancel mailings and e-mails
Upon registering ("opting in"), you may begin receiving communications from us. These messages will always contain unsubscribe instructions. If you would like to correct, update, add, or delete personal information, simply let us know by clicking here or telephoning 1-321-274-1741 Mondays through Fridays 9:00 AM to 5:00 PM Eastern Time.
C.7. Surveys
From time to time our site may request information from users via surveys. Participation is completely voluntary. Information requested may include demographic information (such as age and zip code). This information will be used for purposes of monitoring or improving the use and satisfaction of this site.
C.8. We will not record information from "e-mail this page to a friend"
If you use our referral service to inform a friend about our site, the friend's e-mail address is not saved, and we do not contact the friend again. We will ask for the friend's e-mail address for the sole purpose of sending this one-time e-mail.
D. YOUR MEDICAL INFORMATION
D.1. How we store your personal medical information
Storing your data allows our site to assemble your information so that you can then print your personal emergency medical information wallet file. When you log into our system and fill in the blanks to complete your personal emergency medical file, you are creating your own personal and private data storage account, much like an online bank account. Your encrypted information is stored on a server that is protected by state of the art security systems.
Your data is garbled by our encryption programs before being stored. What does that mean to you? Even if a hacker gets through our formidable safeguards, all they can retrieve will be gibberish.
D.2. How we utilize your personal medical information
The information you provide will be used to create your personal emergency medical file and wallet file.

F. GOVERNING LAW
The corporate laws of the State of Florida shall govern all issues concerning your relative rights and ours. All other questions concerning the construction, validity, enforcement and interpretation of this Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to principles of conflicts of law. By accepting these terms and conditions, you agree to irrevocably submit to the exclusive jurisdiction of the state and federal courts sitting in Orlando, Florida, for the adjudication of any dispute hereunder or in connection herewith or with any transaction contemplated hereby or discussed herein.
Both you and we hereby irrevocably waive, and agree not to assert in any suit, action or proceeding, any claim that it is not subject to the jurisdiction of the courts described herein. We both further agree that any such suit action or proceeding filed outside the jurisdiction of these courts is improper.
Both you and we agree to first, directly confer if there are disputes, second, use a mediator if we are unable to resolve disputes directly within 90 days, and third, to submit lingering disputes to arbitration under the Rules of the American Arbitration Association. A single neutral arbitrator, acceptable to both parties, shall have the authority to determine a fair resolution. Court proceedings will be invoked as a last resort, should arbitration fail to adequately resolve the claims of either party. In any case regarding such procedures, both parties hereby waive any right to monetary relief.
F.1. Service
You also hereby irrevocably waive personal service of process (and consent to process) being served in any such suit, action or proceeding. Instead, a copy of such service, should the need ever arise, will be mailed to the home address you have provided. H. DEFINITIONS
Unless the context clearly requires another meaning, the following terms shall have the meaning assigned herein:
Autocomplete /Autofill
A feature in Web browsers and other software that saves your text entries, and compares them with new entries. When you type a few letters, it displays a list of possible words you may be trying to type. A similar feature, Autofill, automatically inserts user data such as passwords, name, address and credit file numbers into the fields of a Web page form or log-in page.
Browser
A client program that retrieves documents and other materials from an HTTP server and displays them in accord with HTML specifications. Internet Explorer is the most used browser at this time and there are many others.
Cable Modem
A device that allows a computer to connect to a cable television system and connect to a computer network - cable modems work at speeds approaching Ethernet connections.
Compliant Browser Software
Our web site employs powerful encryption technology available through a 128-bit Secure Socket Layer (SSL). Using SSL, your personal information can be trusted to arrive privately and unaltered. It is reportedly impossible to decrypt a message protected with 128-bit encryption. In order to take maximum advantage of this technology, your browser must support 128-bit encryption. Dial-up
A computer connection that is brought up and brought down as needed - a simple version is dialing in to a service provider over a modem as a dumb terminal - SLIP and PPP can also be dial-up connections - also known as a switched connection.

Acronym for Domain Name System, which identifies each computer as a unique location on the Internet. DNS uses an Internet protocol address system (see IP Address) to translate from domain names to IP numbers and vice-versa.
DNS Server
The computer you use to access the DNS and which allows you to contact other computers on the Internet.
Email
A software application that allows one to exchange messages with someone else.
Encryption programs
Any procedure used in cryptography to convert plain text into ciphertext (encrypted message) in order to prevent any but the intended recipient from reading that data.
External Information
We define External Information on this web site as information produced by third parties (advertisers or others) who may be linked with our site. It is any information other than that created by us or by you within this site. When you click on a link or an advertisement, your browser leaves our site; from that moment onward, you are receiving External Information. Firewalls and other technology
Any system designed to prevent unauthorized access to or from a private network. Firewalls can be both hardware and software, or a combination of the two. Firewalls are used to prevent unauthorized Internet users from accessing private networks connected to the Internet. All messages entering or leaving are passed through the firewall, which examines each message and blocks those that do not meet specified security criteria.
FTP
Acronym for File Transfer Protocol, a method of serving and obtaining files over the Internet.
HIPAOS
HIPAOS is an acronym for "Health Information Protection and Online Storage." Because that phrase is far too long to be a company name, our company is incorporated under its acronym, HIPAOS, LLC.
HIPAOS Data Network
Our network begins at the point on the Internet where the electronic signal from your computer connects with our signal. It includes wires, cables, routers, firewalls, computers and servers on our side of that connection point. It also includes the software we use to operate that network.
HTML
Acronym for Hyper Text Markup Language, the text markup language used to insert tags which allow a Web browser to correctly display a hyper-text document. HTML is a subset of the Standard Generalized Markup Language (SGML) first invented to display legal texts and now the world standard for large documentation projects.
HTTP
Acronym for Hypertext Transfer Protocol, the set of rules for exchanging files (text, graphic images, sound, video, and other multimedia files) on the World Wide Web.
HTTPD
Acronym for Hyper-text Transfer Protocol Daemon. A daemon is a program that runs continuously and exists for the purpose of handling periodic service requests that a computer system expects to receive. The daemon program forwards the requests to other programs (or processes) as appropriate. Each server of pages on the Web has an HTTPD or Hypertext Transfer Protocol Daemon that continually waits for requests to come in from Web clients and their users.
Hypertext Link
Element on a Web page which you click on to jump to another location (on the page, the site or the Web). The mouse pointer changes when it is placed over such a link. Most hyperlinks appear as underlined and/or colored text on a Web page.
Internet
The name given to the collective electronic network of computers and computer networks which are interconnected throughout the world - invented by the ARPAnet at the US Dept. of Defense.
Internet Access Provider (IAP)/Internet Service Provider (ISP)
An organization or commercial enterprise which provides access to the Internet.
IP Address
Your machine and every other connected to the Internet has its own unique numerical address known as an Internet Protocol address (IP address). The IP address takes the form of four numbers separated by dots, for example: 123.45.67.890.
MACTCP
A program used on Macintosh computers to provide socket connections for SLIP and PPP connections.
Modem
A device that modulates and demodulates telephone tones to allow for the multiplexing of information on a telephone network (for high-speed cable connections, see "Cable Modem").
Multimedia
Documents which contain text, sound, graphics or video elements that are all capable of being displayed to the user.
PC
Acronym for Personal Computer.
Personal emergency medical information wallet file, or wallet file.
The end product from your use of this web site. When printed, it is designed to fit into a standard credit card slot in your wallet. Yours will contain as much or as little personal health information as you in your sole discretion choose to store in your account on this site. We are providing the format. You, and you alone, are responsible for the accuracy of health information data that ends up in your wallet file.
PPP - Point to Point Protocol
An Internet standard for electronically connecting a remote computer to an IP network.
Secure Data Base
Means the hardware (computers and servers) on which your personal health information is stored. The system is protected behind firewalls and all information you provide is encrypted before it is stored . Anyone not authorized to access your files would only view garble should they even be able to enter this data base.

Secure Socket Layer (SSL)
A protocol developed by Netscape for encrypted transmission over TCP/IP networks. It sets up a secure end-to-end link over which HTTP or any other application protocol can operate. The most common application of SSL is HTTPS, which stands for SSL-encrypted HTTP.
